Terms and Conditions

These conditions shall apply to all online transactions between The Willow Tearooms (“COMPANY”) and any person, firm or company (“the Purchaser”) placing an order online with The Willow Tearooms for the supply of any goods (“the Goods”). The Willow Tearooms by accepting any order for Goods from the Purchaser agrees to sell and the Purchaser agrees to purchase such Goods at the price stated on The Willow Tearooms website and on the sole basis of the terms and conditions of The Willow Tearooms stated herein.

1. PRICE

Prices for Goods include The Willow Tearooms standard packaging, VAT (VAT No: 382 9669 94) and postage or carriage within the UK mainland excluding the lights.

2. SECURE ONLINE PAYMENT

COMPANY provides a secure payment system by utilising the services of PSP for all online payments. Payments can be submitted online using protocol 128 bit SSL (Secure Socket Layer), the strongest commercially available level of encryption. The private data of the Purchaser will be encrypted at all times whilst in transit over the Internet. The Purchaser should see a solid padlock in their browser status bar, which indicates that the encryption is taking place. Credit card payments can be made using Visa, MasterCard, Eurocard, Delta, American Express, Switch and Solo.
Goods will only be despatched once payment has been received in full.

3. RETENTION OF TITLE

Property in the Goods shall not pass until the full amount has been paid.

4. DELIVERY

COMPANY will make every effort to dispatch orders within 2 working days of receipt of payment. The standard prices listed on the website include Second class delivery charges within the UK.
The Purchaser can contact The Willow Tearooms for an upgraded UK delivery service, (1st Class). The extra charges will be quoted on request.

Orders for Christmas must be received by The Willow Tearooms NO LATER than the first Monday in December.

5. CANCELLATIONS

The Purchaser can cancel an order prior to dispatch or within 7 working days of receipt of Goods by Telephone +44 (0) 141 332 0521 or Email sauchiehallstreet@willowtearooms.co.uk, stating the “Order” reference number which is automatically emailed to the Purchaser on receipt of the online order by The Willow Tearooms. The Purchaser’s credit card will be refunded by The Willow Tearooms for the full amount within 2 working days if the Goods have not been despatched. If, within 7 working days of receipt of Goods, the Purchaser wishes to cancel the contract, the Goods must be returned to COMPANY Ltd, 217, Sauchiehall Street, Glasgow, G2 3EX suitably packaged, whereupon the Purchaser’s credit card will be refunded by The Willow Tearooms for the full amount within 2 working days.

6. COMPLAINTS/CUSTOMER SERVICE

The Purchaser should inform The Willow Tearooms immediately of any problems by Telephone +44 (0) 141 332 0521 or Email sauchiehallstreet@willowtearooms.co.uk Complaints are taken very seriously by The Willow Tearooms and will be dealt with within 5 working days, although most complaints can be corrected within a few hours. Please note that the Purchaser is also welcome to contact The Willow Tearooms on any issue relating to their order on the contact telephone or email listed above. The Willow Tearooms operating hours are from 0900am GMT to 1700pm GMT, Monday to Saturday and 1100am GMT to 1700pm GMT, Sunday.

7. DAMAGED GOODS

If the Goods are damaged the Purchaser should contact The Willow Tearooms within 3 days of receipt of Goods. Damaged Goods must be returned to The Willow tearooms, 217 Sauchiehall Street, Glasgow, G2 3EX, suitably packaged. The Willow Tearooms will replace or refund the items concerned.

8. SUBSTITUTIONS

The Willow Tearooms reserves the right to substitute items of similar or greater value, if for any reason those listed on the website are unavailable.

9. INSURANCE

Liability insurance is automatically included by The Willow Tearooms on all Goods ordered.

10. FORCE MAJEURE

The Willow Tearooms will exercise every reasonable effort to meet the requested dispatch date. The Willow Tearooms shall not, however, be liable for any loss or damage due to delays or failure to ship resulting from any cause beyond its reasonable control, such as but not limited to securing necessary export licenses, compliance with laws or regulations, acts of God, acts or omissions of the Purchaser, acts of civil or military authority, judicial action, defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots.

11. ONLINE PRESENCE

No warranty is given by The willow Tearooms that their website will be constantly online or free of defects and errors at any time.
12. PRIVACY POLICY

The Willow Tearooms collects the information provided by the Purchaser at the time of ordering and uses this information lawfully and in accordance with the Data Protection Act 1998. Information is collected by The Willow Tearooms to process the Purchaser’s order and also to provide the highest level of customer service possible. The Willow Tearooms will not email marketing material to the Purchaser unless prior consent has been obtained. The Purchaser can contact the Proprietor of The Willow Tearooms, Anne Mulhern, by Email anne@willowtearooms.co.uk if further information on The Willow Tearooms Privacy Policy is required.

13. JURISDICTION

These terms and conditions shall be governed by and construed in accordance with Scottish Law and the Purchaser hereby agrees to be subject to the jurisdiction of the Scottish Courts.
None of the above terms affect your statutory rights as a consumer.
